This policy explains what happens if you cancel a package, a project, or a Maintenance & Support retainer, and how EU consumer withdrawal rights apply to the software services we sell. It replaces any generic template terms with rules written for how we actually work.
If you cancel after ordering but before we've begun the discovery step or any scoped work, any payment made is refunded in full, less the reasonable cost of discovery work already carried out on your project, if any.
If you cancel after work has started, we invoice pro-rata for the work completed against the agreed scope up to the point of cancellation, and refund the balance of any payment already made. Work delivered up to that point — including partial source code — is handed over to you on settlement of that final invoice, consistent with our intellectual-property terms.
Once a deliverable (a design file, a piece of source code, a document) has been delivered and accepted by you, it is not refundable on its own — cancellation from that point forward is handled under the "during a project" terms above, not as a per-deliverable refund.
Retainers are billed monthly in advance and can be cancelled at any time with 30 days' written notice. You're billed for the notice period; unused hours within a billing month do not carry over to the next month or convert to a refund.
If you're a consumer (buying for personal use, not for a trade, business, or profession) resident in the EU, you generally have a 14-day right to withdraw from an online purchase without giving a reason, under the EU Consumer Rights Directive. Because our packages are scoped specifically to your project and work begins at your request, this right ends once we begin work with your express agreement, and you acknowledge losing the right of withdrawal by requesting that we start. Before that point, you can withdraw and receive a full refund by emailing support@smartcodesolution.com.
If you're purchasing as a business, for your trade or profession, the statutory consumer withdrawal right above does not apply. Cancellation is governed by the "before work starts" and "during a project" terms above, and by the payment schedule in your proposal.
Email support@smartcodesolution.com with your order reference. We confirm the cancellation terms that apply and process any refund to the original payment method within a reasonable time.
